Terms of Service
Terms of service and sale for Light Hosting.
Terms of Service
These Terms of Service ("Terms") govern the hosting services sold at hosting.nortexdev.com ("Light Hosting", the "Services") by NorteX (the "Provider") to you (the "Customer"). By creating an account, placing an order or using the Services, you agree to these Terms, the Service Level Agreement, the Abuse Policy and the Privacy Policy, which form part of these Terms.
Effective 29 October 2026.
1. The Services
1.1 Light Hosting provides managed hosting of Light Store and other software offered on the order page. Each plan includes a server with the resources listed on its order page, a control panel, a database and an automatically issued HTTPS certificate for one domain.
1.2 Light Store provided with the Services is licensed to the Customer under the Light Store EULA for as long as the Service is active.
1.3 The Customer is responsible for registering a domain and creating the DNS records shown in the control panel. The Provider does not register or manage domains.
2. Account
2.1 To order, the Customer must create an account with accurate and complete information and keep it up to date.
2.2 The Customer must be at least 18 years old, or the age of majority in their country, and able to enter into a binding contract.
2.3 The Customer is responsible for all activity under their account and for keeping their credentials secure. Unauthorized access must be reported to the Provider without delay.
3. Prices and Payment
3.1 Prices are shown on the order page in US dollars. Light Store hosting costs a fixed price of $5.00 per month.
3.2 Taxes are added where required by law and shown before checkout.
3.3 Services are billed monthly in advance. The renewal invoice is issued before the due date and charged automatically to the payment method linked to the account.
3.4 The Provider may change prices with at least 30 days' notice by email. A new price applies from the first billing period that starts after the notice period. The Customer may cancel before then.
4. Free Trial
4.1 New Customers may receive their first month free with the code FREETRIAL, or as otherwise announced. A payment method must be linked to start the trial.
4.2 Unless cancelled before the trial ends, the Service renews at the regular price.
4.3 One free trial is allowed per Customer, household, payment method and domain. Accounts created to obtain further trials may be suspended or terminated.
5. Late Payment
5.1 A Service whose invoice is unpaid 3 days after its due date is suspended. Its data is kept, but the store is offline.
5.2 A Service unpaid 14 days after its due date is terminated, and its data is permanently deleted.
5.3 Paying the invoice during suspension restores the Service.
6. Cancellation and Withdrawal
6.1 The Customer may cancel at any time with Request Cancellation on the service page, either immediately or at the end of the current billing period.
6.2 Payments for a billing period that has started are not refunded, except as required by law or under Section 6.3.
6.3 A Customer who is a consumer in the European Union may withdraw from the contract within 14 days of ordering without giving a reason. By ordering, the consumer requests that the Service start immediately. On withdrawal, they pay for the part of the Service provided up to that point and receive a refund of the rest. Withdrawal can be requested at contact@nortexdev.com.
6.4 Refunds are made to the original payment method.
7. Customer Responsibilities
7.1 The Customer is solely responsible for the content of their store, the products they sell, and their compliance with the laws that apply to their business, including consumer, tax and data protection law.
7.2 The Customer is the controller of personal data their store processes about its users and customers, and is responsible for their own terms and privacy policy towards them. The Provider processes that data only to provide the Services, as described in the Privacy Policy.
7.3 The Customer must use the Services in line with the Abuse Policy.
8. Backups
8.1 The control panel lets the Customer create and restore backups. The Customer is responsible for keeping backups of their data.
8.2 Any backups the Provider makes of its infrastructure are for disaster recovery only and are not guaranteed to be available for restoring an individual Service.
9. Availability and Support
9.1 Availability is guaranteed only as described in the Service Level Agreement.
9.2 Support is provided through tickets in the client area.
9.3 The Provider may perform maintenance, and will announce planned maintenance in advance as described in the Service Level Agreement.
10. Suspension and Termination
10.1 The Provider may suspend or terminate a Service under the Abuse Policy, for late payment under Section 5, or for any other material breach of these Terms.
10.2 Where possible, the Provider will notify the Customer and give them a chance to fix the breach before suspending, unless the breach is severe, illegal or harms other Customers or the Provider's infrastructure.
10.3 After termination, the Service's data is permanently deleted. The Customer should export anything they want to keep before cancelling.
10.4 The Provider may discontinue a plan with at least 30 days' notice, refunding any prepaid period not used.
11. Limitation of Liability
11.1 Except as guaranteed by the Service Level Agreement, the Services are provided "as is" and "as available".
11.2 To the maximum extent permitted by law, the Provider is not liable for indirect damages, lost profits, lost sales, business interruption or lost data.
11.3 The Provider's total liability is limited to the amount the Customer paid for the affected Service in the 12 months before the claim.
11.4 Nothing in these Terms limits liability that cannot be limited by law, or the statutory rights of consumers.
12. Changes to These Terms
The Provider may update these Terms. Material changes are announced by email at least 30 days before they apply. Continuing to use the Services after that date means accepting them. A Customer who does not accept them may cancel before then.
13. Governing Law
These Terms are governed by the laws of Poland. Disputes are resolved by the competent courts of Poland. Consumers keep the protection of the mandatory laws of their country of residence and may also bring claims there.
