EULA (End-User License Agreement)
Agreement between you and the Licensor regarding the Software, including telemetry and the privacy policy.
EULA (End-User License Agreement)
By licensing, installing, using, or modifying the Software, you agree to be bound by the terms of this Agreement. Any violation of these terms may result in immediate termination of your license and revocation of any support or services provided by the Licensor.
1. Grant of License
Subject to your compliance with this Agreement, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:
1.1 Use the Software for personal and commercial purposes.
1.2 Modify the Software for your own internal use.
1.3 Operate the Software in connection with your own business, including earning revenue from goods or services sold through the Software.
2. Restrictions
You are not permitted to:
2.1 Redistribute, publish, or disclose the source code of the Software in any form.
2.2 Sell, sublicense, rent, lease, or otherwise transfer the Software or its source code to third parties.
2.3 Provide the Software, in whole or in part, as part of a service or platform for third parties (e.g., Software-as-a-Service), unless you have obtained a separate commercial license from the Licensor.
2.4 Remove or alter any copyright notices, trademarks, or proprietary rights notices included in the Software, unless you have obtained a separate license for watermark removal from the Licensor.
3. Ownership
The Software is licensed, not sold. The Licensor retains all rights, title, and interest in and to the Software, including all intellectual property rights.
4. Updates and Modifications
4.1 The Licensor may provide updates, patches, or modifications to the Software at its discretion.
4.2 Any modifications you make to the Software remain subject to this Agreement and may not be redistributed.
4.3 To offer updates, the Software periodically downloads a public release manifest from the Licensor's update mirror. This request sends no data about your store other than the Software version in the request's User-Agent header. This applies to every version of the Software.
5. Telemetry
5.1 Version 26 and older do not send telemetry. Section 5 applies only to version 27.0.0 and later.
5.2 Starting with version 27.0.0, the Software sends a report to the Licensor's update mirror once a day ("Telemetry"). Telemetry is enabled by default. You may disable it during installation or at any time under Settings > Telemetry in the admin panel. When disabled, no reports are sent.
5.3 Every report contains:
- an anonymous instance ID generated by your store,
- the Software version and release channel,
- your store's URL, domain and name,
- whether installation has been completed and the date the first user account was created,
- whether the watermark has been removed under a watermark removal license, and a fingerprint of that license file.
5.4 Each report may additionally contain the following categories, each of which can be turned off individually:
- Environment (on by default): PHP, Laravel and database versions, operating system and architecture, configured drivers, application environment, timezone and locales, currencies, active theme, installed addons, enabled payment gateways, enabled sign-in providers, enabled store features and queue health.
- Catalog size (on by default): the number of products, vendors, users, categories, reviews and licenses.
- Sales totals (on by default): the number of completed orders, total revenue per currency and the date of the last sale.
- Store logs (off by default): warnings and errors written to the store log since the previous report. Email addresses, IP addresses, tokens, passwords and SQL values are removed before sending.
5.5 Telemetry never contains individual orders, customer records, payment details or credentials.
5.6 You can view the exact contents of the next report at any time using Preview report in the admin panel, or by running php artisan telemetry:report --preview.
5.7 Telemetry is used to prioritize fixes and development, to provide support, and to verify compliance with this Agreement.
6. Privacy Policy
This section describes how the Licensor processes data received from the Software. The Licensor is the controller of that data.
6.1 Data received. The Licensor receives the Telemetry described in Section 5. When a report is received, the country and network operator associated with the sending server's IP address are also recorded. The IP address itself is used only for rate limiting and is not stored. Update checks (Section 4.3) are not stored by the Licensor beyond short-lived infrastructure logs.
6.2 Legal basis. Telemetry is processed on the basis of the Licensor's legitimate interest in maintaining, supporting and protecting the Software (Article 6(1)(f) GDPR). You may object at any time by disabling Telemetry.
6.3 Retention. Daily reports are kept for as long as they are needed for the purposes in Section 5.7. Only the 60 most recent log excerpts are kept per installation; older ones are deleted automatically.
6.4 Deletion. Delete reported data under Settings > Telemetry permanently deletes every report and log excerpt your store has sent and assigns it a new instance ID. Disabling Telemetry alone stops new reports but does not delete data already sent.
6.5 Processors. Telemetry is received and stored on Cloudflare's infrastructure, which acts as the Licensor's processor. The Licensor does not sell Telemetry or share it with any other third party.
6.6 Your rights. Subject to applicable law, you have the right to access, rectify, erase and restrict the processing of your data, to object to its processing, and to lodge a complaint with a supervisory authority, in Poland the President of the Personal Data Protection Office (UODO). Requests other than deletion, which you can perform yourself under Section 6.4, can be sent through the Licensor's support channels.
6.7 Your customers' data. You are the controller of all personal data your store processes about your customers and users. That data stays on your server and is never sent to the Licensor, except to the extent it appears in store logs you choose to share under Section 5.4. You are responsible for your own privacy policy towards your customers.
6.8 Third-party services. Independently of Telemetry, the Software contacts third-party services to function: jsDelivr for currency exchange rates and DB-IP for its country lookup database, as well as any payment gateway, sign-in provider, storage, email or other integration you configure. Those services are governed by their own terms and privacy policies.
6.9 Changes. The Licensor may update this Privacy Policy. Any change that extends what Telemetry contains will be released in a new version of the Software and described in its changelog.
7. Termination
This license will automatically terminate if you breach any provision of this Agreement. Upon termination, you must immediately cease using the Software and destroy all copies in your possession.
8. Disclaimer of Warranty
The Software is provided “AS IS,” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, the Licensor shall not be liable for any damages, including but not limited to loss of profits, business interruption, or loss of data, arising out of the use or inability to use the Software.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Poland. Any disputes arising from or relating to this Agreement shall be resolved exclusively in the competent courts of Poland.
11. Entire Agreement
This Agreement, including the Privacy Policy in Section 6, constitutes the entire agreement between you and the Licensor regarding the Software and supersedes all prior or contemporaneous understandings.
By installing, copying, or using the Software, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
